คำตอบ มีคำพิพากษาฏีกาวินิจฉัยไว้ ดังนี้
คำพิพากษาฎีกาที่ ๕๔๑๗/๒๕๔๙ จำเลยขอให้เรียกบริษัท ผ. เข้าเป็นเป็นคู่ความร่วมกัยจำเลยเนื่องจากจำเลยเป็นผู้ลงลายมือชื่อสั่งจ่ายเช็คพิพาทให้แก่บริษัท ผ. ต่อมาบริษัท ผ. ได้สลักหลังโอนให้แก่โจทย์ ดังนั้น หากศาลพิพาษาให้จำเลยชำระหนี้ตามเช็คพิพาทให้แก่โจทก์ จำเลยในฐานะผู้ลงลายมือชื่อสั่งจ่ายเช็คพิพาทก็ไม่อาจใช้สิทธิไล่เบี้ยเอาจากบริษัท ผ. หลังได้ จึงไม่อยู่ในหลักเกณฑ์ที่จะเรียกบริษัท น. เข้ามาเป็นคู่ความในคดีตามประมวลกฎหมายวิธีพิจารณาแพ่ง มาตรา ๕๗(๓)
